Mesdag Dairy Fund and Nitrogen Claim have filed summary proceedings against the State and RIVM. They demand openness and transparency in the nitrogen calculations and underlying data. The preliminary injunction proceedings will be filed on Friday morning, December 13.
The organizations have been pushing for all data and information about nitrogen emissions to be made available for some time now. The data and calculations form the basis for the new legislation (the emergency law) from the cabinet and the policies of the provinces. "The substantiation of that legislation cannot be checked on the basis of the available information", the Mesdag Dairy Fund and Nitrogen Claim explain.
Sticking to transparency
The foundations have already earlier procedures brought against the RIVM and the State, but according to the 2 parties this has only provided part of the desired information. According to them, RIVM has reported that 'a legal test' prevents the measurement institute from making all information available. The foundations emphasize that Minister Carola Schouten (Agriculture, Nature and Food Quality) regularly stated in the media that she attaches value to transparency. "But, this does not appear to be the case yet," the organizations say.
