The Nitrogen Claim Foundation (SSC) holds the state liable for damage resulting from the nitrogen policy. The foundation calls on livestock farms that have made a PAS report, are in financial trouble or have been shut down after enforcement to do so.
The organization has have a sample letter drawn up which farmers can send to the Ministry of Agriculture without a valid permit. "The state is responsible for the situation in which initiators with PAS calculations and/or PAS reports find themselves since May 29, 2019," said Nitrogen Claim in a statement.
The organization has commissioned lawyer Franca Damen to hold the state liable (in advance) for all damage that farmers have already suffered and/or will suffer in the future. Damen has also prepared the sample letter for individual farmers. The SSC also holds the government liable in advance for the damage that may result in the absence of a so-called assessment framework for fertilization and grazing, for which a nature permit may be required.
