SSC urges rapid legalization of PAS reporters

The Nitrogen Claim Foundation (SSC) again urges in a letter to outgoing minister Carola Schouten (LNV) to speed up the legalization of PAS notifications and exemptions. "Every day it becomes more and more clear that legalizing this group of companies, which are in this situation through no fault of their own, will become a mission impossible."

As long as they have not been legalised, PAS reporters may have to deal with enforcement. Dozens of requests have already been made and filing requests will become even easier as the court ruled on June 25 that company details of PAS reports may be made public, SSC said. in the letter from 15 July.

No financing
The foundation also adds a position paper from Rabobank dated June 21, in which the bank writes that it cannot finance a company if there is no permit, and the business activities are therefore not legal.

The Nitrogen Reduction and Nature Restoration Act (Wsn) includes a passage that regulates the legalization of this group of PAS bottlenecks, SSC cites. "However, it is not clear how the development reserve, the nitrogen required for legalization, is formed. The Council of State has also made it clear in its advice to LNV that the elaboration of the WSN in this way does not offer a solution for legalization."

'No task province'
In addition, last week provinces adjusted their policy rules in connection with the formation of the nitrogen bank. SSC: "It is made clear in these policy rules that legalization of the PAS victims is not a task of the province. And that is strange, since the direction for the granting of permits lies with the provinces." SSC sees this change in policy rules as a waiver of joint responsibility.

Financial damage
If rapid legalization is not forthcoming, companies will soon experience financial damage, SSC expects. According to the foundation, it is also important that more than two years of uncertainty for entrepreneurs comes to an end. "One can expect from a government that all companies involved will be legalized before the end of this year. The liability of LNV by SSC on April 1 must be the means of pressure that this will also happen!"
