The Court of Appeal of The Hague has declared the ban on the use of plant protection products binding on appeal, which was filed by interest representatives Nefyto and Artemis. This means that the professional use of these products outside of agriculture is permitted again under certain conditions.
Since October 2016, it has been prohibited to use plant protection products on pavements. Later this ban was even extended to all non-agricultural uses. With the ruling of the court, this so-called prohibition of use has now been declared unfounded. "The judge ruled in favor of the developers of plant protection products, because there was no legal basis for the ban," it said.
'A permit must be final'
Nefyto and Artemis are happy with the verdict. "The transition envisaged in the 'Implementation Program for the Future Vision for Crop Protection 2030' requires a shift to biological products and low-risk products. Companies can only make responsible investments in the development and registration of new products if the decision to authorize them is not a ban on use on political grounds," the parties wrote in a joint press release.
