The implementation of the Environment and Planning Act is again postponed. The date of 1 July 2019 is also not feasible. This was announced by outgoing minister Melanie Schultz van Haegen, Infrastructure and the Environment.
The introduction of the Environment and Planning Act has been postponed due to the complexity of the regulation and the 4 supplementary laws. This postponement has no consequences for the ultimate end date of the transition, which is 2029.
Thought of before
Lawyer and planner Jerry de Rijke came up with this conclusion† "The year 2019 was not realistic and is not expected to be introduced until 2020 or 2021," De Rijke said in April Boerenbusiness know. De Rijke indicates that the current rules will remain in force until then.
Simplifying current law
The aim of the Environment and Planning Act is to simplify the legislation and regulations for applying for permits. In addition, the Environment and Planning Act must replace the current environmental regulations. As a result, farmers will no longer have to deal with multiple zoning plans in the future.
A farmer who wants to expand his business and needs a permit must submit an environmental plan when the Environment Act is in force. The municipality will test the plan for environmental and environmental factors.
It is still unclear what the new implementation date will be. The cabinet must make a decision on this soon.
