A Kentucky court has ruled that the green-yellow color combination belongs to the John Deere brand and may not be used by other manufacturers. Deere sued the sprayer manufacturer Fimco, because it also sold their machines in the green-yellow.
The Kentucky judge calls John Deere's green-yellow a "famous brand." With that, John Deere wins the lawsuit it filed to defend their corporate colors. This gives the company Fimco, producer of the Ag Spray Equipment machines, a ban on the use of the color combination. According to Deere, the lawsuit is only one part of their goal to protect their image and intellectual property.
Buyer is misled
In addition to banning the color combination, John Deere also believes that people are confused by the colors when used by another manufacturer. That's bad publicity for Deere's own brand. The judge ruled in favor of the world's largest machine manufacturer in all respects. According to the judge, the color combination has been associated with John Deere since the 60s.
Machines no longer sold
Fimco has 60 days to draw up a plan, in which it will be clear how the green-yellow color combination will be removed. The sale of machines is no longer allowed and marketing and advertising may no longer contain the colors.
