Dairy farmers can register for the land-related shortage scheme until February 15 at the latest. This is when the dairy cattle phosphate surplus from 2014 (due to special circumstances) was smaller than in previous years.
For land-relatedness, the reference date is the entire year 2014. This is in contrast to the phosphate rights, where the reference date is 2 July 2015. If a dairy farmer can demonstrate that he/she has a bottleneck, this must be reported to RVO.nl.
When a bottleneck?
A bottleneck occurs when phosphate production is demonstrably 2014% less in 5 due to special circumstances, such as:
A dairy farmer can also qualify if he temporarily had a larger phosphate space, for example because cooperation in the realization of a nature reserve or maintenance of the (public) infrastructure.
Land-based growth of dairy farming
The aim of the Land-Based Dairy Farming Growth Act is to slow down growth in dairy farming. A dairy farm with a surplus has to absorb part of this growth with extra land. With a higher dairy cattle phosphate surplus in 2014, less land will be needed for the expansion.
Until 1 January 2018, the land-related nature was described in an AMvB (General Administrative Order). As of 1 January this has been included in the Fertilizers Act.
