Bayer and Syngenta lose neonics lawsuit

The European Court of Justice reports May 17 that the European containment of neonicotinoids (neonics), which were imposed in 2013, are correct. Bayer and Syngenta filed a lawsuit to challenge the measure, but they have now been unsuccessful.

The Court confirms the validity of the restrictions introduced at European level in 2013 against the insecticides clothianidin, thiamethoxam and imidacloprid. “This is because of the risks these substances pose to bees yield", according to a statement from the Court. According to the Court of Justice, new studies support the ruling already made, and the European Commission was therefore right.

Approval Criteria
The 2013 decision was taken on the basis of a study by the European Food Safety Authority (EFSA). The conclusion was that the 3 substances no longer meet the approval criteria. According to the European Court of Justice, the European Commission has justified the restriction. According to the chemical companies are correct the assessment criteria, however not.

So this is not about the complete ban on neonicotinoids set on April 27. Bayer, BASF and Syngenta had filed the lawsuit. In addition, Syngenta had requested compensation of almost €368 million.

Fipronil restriction called back
The European Court of Justice has largely reversed a restriction on the use of fipronil. According to the Court of Justice, the European Commission laid down that limitation "without having weighed up the consequences of its action in advance."

Bayer is disappointed
Bayer has expressed disappointment at the ruling and is confident of the safety of its products when used in accordance with label instructions. Bayer will assess the consequences of the verdict and consider possible legal options.
