May makes another striking statement

31 July 2018 - Redactie Boerenbusiness

British Prime Minister Theresa May has made another striking statement. It is said to have reached an unacceptable compromise with the European Union (EU). This by saying that European judges (post-Brexit) will have the last word on important matters of the future relationship between Britain and the EU. That reports Business Insider.

According to the newspaper The Times The UK government has agreed to use the European Court of Justice as an arbiter of legal issues surrounding the nearly €45 billion Brexit bill and the 3,8 million European citizens living and working in Britain.

Keep last word
The program stands for that the EU's highest court, based in Luxembourg, will have the last word on disputes related to elements of the divorce even after Brexit is completed. The draft agreement states that directors of either side may at any time jointly decide to bring a dispute before the Court of Justice; even when the British judges are against it.

Each EU Member State provides 1 judge to the European Court of Justice, which also has the final say on the transition phase for Northern Ireland. In effect, this means that the Court has power over British territory. Under the model the EU is proposing, Northern Ireland will remain in the Customs Union and Internal Market if no way is found during the negotiations to secure the invisible border on the island of Ireland.

Unacceptable
Conservative Brexiteer Bernard Jenkin calls the agreement unacceptable. "This goes very far, because this gives the European Court of Justice status in the withdrawal agreement, for which there is no approval from the British Supreme Court," says the parliamentarian.

At the beginning of the negotiation process, May multiple times promised that after Brexit the European Court's control over Great Britain will end. "We won't really be out of the EU if we don't control our own laws," the prime minister said during her Lancaster House speech in January 2017.

However, little by little May has a retreating movement made. Similarly, European agencies, of which she wishes to remain a member, fall under the jurisprudence of the European Court. The European Court also has the last word on the trade rules of the EU, which Great Britain will comply with.

Calls resumed later
Talks will resume in mid-August and will then take place weekly until the European Council summit in October. A source told Business Insider that. The parties need to agree on the Northern Ireland border in order to reach a comprehensive withdrawal agreement in time and avoid a no-deal scenario.
