Netbeheer Nederland (NBNL) and the Association of Drinking Water Companies in the Netherlands (Vewin) have set up the Leg- en Ligsrecht Platform. LTO and the network operators previously arranged these conditions in an annual mutual consultation. After the recent termination of this consultation, this platform will replace it.
Energy network operators and water companies make agreements with farmers for the laying of cables and pipes. This is often a complex and time-consuming process in which matters such as construction and access for maintenance must be arranged. Grid operators use fixed sets of conditions in these negotiations.
Review by independent committee
The new platform should help to establish reasonable terms for contracts for the laying and maintenance of cables and pipelines on private land. Members of NBNL and Vewin can submit their general terms and conditions for the laying and maintenance of cables and/or pipelines to a committee of experts. The committee checks whether the conditions meet the legal requirements.
With the Leg- en Ligsrecht Platform, NBNL and Vewin want to ensure that the conditions are objectively and transparently guaranteed. The platform must also ensure that an agreement framework is created that is easy to use. The external expert opinion ensures that the legally regulated interests of the land owner are adequately taken into account in the conditions of network operators. NBNL and Vewin expect this to help create support among land owners and their interest groups. Legal proceedings could thus be avoided.
