Minister Schouten of LNV is no longer allowed to keep a series of documents about the fipronil affair in 2016 and 2017. Poultry farmers have the right to inspect.
This has been decided by the Council of State. An appeal from a group of Limburg poultry farmers is justified according to the administrative law department† The Limburg court initially agreed with the minister.
The Limburg poultry farmers have set themselves the goal of getting 'the upside down' and the fipronil affair. For them, the verdict is an important boost.
In concrete terms, the poultry farmers wanted access to what they considered to be a crucial report from the report of the NVWA's Risk Assessment and Research Programme. This is about research into and the possible danger to public health and food safety from the possible use of fipronil in poultry houses. It also contains information about the history of the fipronil check-ups. In addition, access was requested to other documents and e-mail traffic from LNV officials and NVWA supervisors. The minister is not obliged in all cases to make documents public without further ado. In some cases, the Council of State only instructs it to take a new decision.
