The Provincial Executive (GS) of Noord-Brabant wrongly gave Rendac permission in 2020 for expansion in the vicinity of a Natura 2000 area. That is why a new decision is needed. It must be made clear whether the step will not lead to significant disruptions or more nitrogen emissions. This is what the East Brabant court in Den Bosch has distinct identity. in a case brought by four environmental organizations, including MOB.
GS gave permission to Rendac in 2020 with a new nature permit. In addition, Rendac was allowed to use unused nitrogen emission space from a previous permit to build additional buildings. In other words, netting was allowed internally using latent space allocated in the past. The environmental organizations appealed, with success.
Parallel with Amercentrale
In its ruling, the court also refers to an earlier ruling, in which it annulled the nature permit of the Amercentrale. Both permits were rejected on the same grounds. The judges point this out subtly: "Therefore, in this case, the court sees no reason to give (GS) the opportunity in these proceedings to rectify the defect in the contested decision."
GS must now make a new decision within six months, according to court instructions. This does mean that a different assessment framework is used for the permit.
Rendac mainly foresees procedural delays
GS van Noord-Brabant are still studying the verdict. Rendac follows developments closely, but states that the installations in which it has invested are not up for discussion. According to the spokesperson, Rendac has made two important investments: A biogas engine has been installed, which generates green electricity and heat, and a thermal afterburner has been installed. This is important and very effective for odor reduction. The installations are both running and will continue to do so, if it is up to Rendac. The company believes that additional procedures have to be completed again before everything is in order in terms of permits.
