Professional ban seems to be a bump when buying peak tax payers

24 August 2022 - Klaas van der Horst - 2 comments

The proposed professional ban for peak loaders near nature reserves could form a hurdle for the approval of the so-called Targeted Purchase Measure (MGA) by Brussels.

This is confirmed by a spokesperson for Minister Van der Wal of Nitrogen Policy. According to the spokesperson, the much-discussed professional ban had not yet been cast in concrete. "If a young entrepreneur is bought out at a nature reserve and wants to continue elsewhere in a sustainable way, who could object," he says.

Buyout peak loaders
However, this proposal comes across differently than before. The idea was initially to buy out peak loaders and then not let them continue at another location. The MGA comes in two variants: MGA1 with buyout of the entire company and MGA2 with buyout of only the company buildings and existing activities, whereby the entrepreneur does keep the ground to do something else with it.

Brussels mainly objects to the ban on continuing elsewhere. The spokesperson for Van der Wal does not know which directorates-general in Brussels have been consulted. There would have been only one more talk, and that at 'low official level'. Van der Wal himself still has to talk to the committee.

Buyout perhaps 'even more attractive'
The ministry has meanwhile announced that the MGA1 will be open longer. Instead of until September 1, the scheme will now remain open until December 1. This offers interested entrepreneurs the opportunity to wait and see what the European Commission finally thinks about the scheme. Without a professional ban, the MGA1 may become even more attractive than Van der Wal suggested earlier this year.
In Limburg in particular, dozens of entrepreneurs are still in talks about buying out.

It is unacceptable that a professional ban is linked to a buy-out arrangement. Such a thing can only exist for legally undesirable professions for society . This does not include the profession of “farmer”. I can assume that this requirement was first put on paper by Mr Remkes . It is then ridiculous that this is pending the EU commission . Van der Wal should not crawl away but show muscles!
