Low-emission stable under guardianship until new judgment

From now on, low-emission barns must be subject to an appropriate assessment that shows that nature is not harmed. For permit granting, use may no longer be made of the emission factors approved so far by the government for certain types of low-emission barns. This is what the Council of State judged on appeal concerning three dairy farms in the province of Utrecht. This means that these dairy farms cannot expand for the time being.

This concerns the granting of new nature permits for two types of dairy barns, types A1.13 and A1.28. The statements mean that emission factors for this types of stables may no longer be used for granting nature permits. The statements do not concern other low-emission barn systems in the dairy sector, nor do they concern low-emission barns in the poultry and pig sector.  

The Administrative Jurisdiction Division of the Council of State indicates that it is aware that this will make licensing in the dairy sector even more difficult, "but the strict European nature conservation rules to which the Netherlands has committed itself do not allow for a different outcome," it said. put. It is therefore important, according to the department, that the research announced by the Minister of Agriculture, Nature and Food Quality into the effectiveness of low-emission stables quickly provides clarity.

This requires the Experts Committee on the Fertilizers Act (CDM) to come up with further advice for the optimum operation of the low-emission barn types, but the Council states that an appropriate assessment and preliminary testing are still necessary.

The case was brought by Coöperatie Mobilization for the Environment (MOB) and Vereniging Leefmilieu.

The N analysis for all houses does not appear to differ from 10000 manure samples, so that it is concluded that the house floor type cannot be distinguished.
