Windmills, solar parks and taxation

June 16, 2017

Beautiful or not. Windmills are now commonplace in the Netherlands and solar parks will follow. Windmills are fiscally equivalent to solar parks. But what does that mean?

The efficiency and aversion to fossil fuels create a demand in the Netherlands for space for wind turbines and solar panels (or solar parks). The use of pastures to meet the demand for space is also being considered. In addition to aesthetic and business economic questions, there are also tax questions.

We currently see 3 ways of investing:

  • Exploitation by third parties, through:
    – Sale of land to third parties;
    – Allowing placement for an annual fee.
  • Exploitation by the owner of the land.
  • Exploitation by a group of farmers, whether or not supplemented by third parties.

In any case, income (and/or company) and turnover tax play a role in all the forms mentioned. In addition, other charges may also apply.
