Environmental Act not in force before 2020

The Environment Act, which is intended to replace the current spatial and environmental regulations, will not be introduced before 2020. That is what Jerry de Rijke, lawyer and planner, said at the National Real Estate Theme Day on Wednesday 19 April in Doorn.

If all goes well, the government wants the law to come into effect in 2019. According to lawyer Jerry de Rijke, this time frame is not realistic. The year 2019 will not be met. The new law will take effect in 2020 at the earliest and possibly only in 2021.' According to De Rijke, the digital system is necessary to make the Environment Act feasible for municipalities. Until then, the current rules for space and the environment in rural areas will remain in force. De Rijke says he knows this because he works closely with the Ministry of Infrastructure and the Environment.

Lawyer Peter Overwater also expects 2019 to be unfeasible. 'Much will depend on the new minister and how important he or she considers the introduction of the Environment Act.' The Environment Act was the hobbyhorse of outgoing VVD minister Melanie Schultz. 

Own insight
The Environment Act bundles all current rules for space and the environment. The government wants to simplify and integrate the rules for spatial projects. Municipalities will implement the law. They will be given much more room than now to apply the law as they see fit and to set rules per area or location. An agricultural municipality, for example, can focus much more on smell than is currently the case. New elements have also been included in the Environment and Planning Act. These are health, energy transition and climate change.

Environment plan
A farmer who wants to expand his business and needs a permit must submit an environmental plan when the Environment and Planning Act is in force. The municipality will test the plan for environmental and environmental factors. The government itself is currently still conducting a lot of research, which will be borne by the applicant after the new law has been introduced.
