New summary proceedings phosphate

More than 400 dairy farmers sign up

More than 400 dairy farmers have registered with the law firms Hekkelman, Linssen and Achmea for new summary proceedings against the State. They want to come under the 2017 Phosphate Reduction Regulation.

The more than 400 dairy farmers have entered into an irreversible investment commitment aimed at growth before July 2015. The law firms are busy testing the applications. They must use this to estimate the feasibility of new summary proceedings.

Testing documents
The dairy farmers have to hand over all kinds of documents to the lawyers. This concerns, for example, financing documents, permits, contractor agreements and purchase invoices for stable equipment and land.

Hope for judge's verdict
This group is applying as a result of the outcome of the 6 lawsuits, which were brought by a total of 52 dairy farmers. on May 4 the judge ruled that the 2017 Phosphate Reduction Regulation is a disproportionately heavy financial burden for the dairy farmers concerned, because they had already entered into irreversible financial obligations. "He was not foreseeable and does not offer any compensation," the judge ruled.

Appeal decision for September
The scheme is therefore non-binding for the 52 dairy farmers. This group does not need to dispose of livestock for the time being. The Ministry of Economic Affairs is challenging the ruling. That made the outgoing Secretary of State Martijn van Dam Friday 12 May known. The outcome of the appeal is expected before September.

All farmers who have enough land for their manure should not be cut or fined... The polluters should be billed... People in the intensive manure industry also want to be able to breathe freely...

if you do 2,2 cow per ha and the organic 1,7 cow per ha, everyone is equal and you no longer have a problem

I'm also a dairy farmer and I'm sick and tired of the nagging from my colleagues.
Everyone knew from 2013 that something was coming, and as an agricultural "entrepreneur" you start taking this into account from that moment on.
Anyone who wishes to do so can also purchase phosphate rights before 2018.
So don't whine, move on to 2017 and arrange things for 2018.
I hope that these so-called colleagues of mine are aware that they are seriously jeopardizing the derogation for 2018 and beyond.
Then we will be pathetic again because in 2018 even more cows have to disappear from our yard, right............................ .......................

Dear Hans, Why do you want to produce poop and have no land for it? I am therefore in favor of GVE/HA, then all the whining is over.

That whole derogation story is a big mess, after all, we knew that land bound would be the sustainable future, see 2013!!!!

and if the derogation farmers including myself have to hand in, because there will be no derogation in 2018, there is no problem at all.

Maybe we can get a little more for our products and animals with some ((fewer cows)) and less work!!!!!

Exactly, all those who have expanded after 2013 should keep quiet!

Willingly made crazy jumps, and then you just have to sit on the blisters! Tired of such guys

Fake entrepreneurs! I I want more than the neighbor, and look at me! Now then, stay a big guy too, and don't sit down and cry
