It took a while, but next Thursday, July 30, the summary proceedings initiated by the Nitrogen Claim Foundation and STAF against the feed measure will be heard. STAF reports on Twitter that the summary proceedings will be dealt with at the Court of The Hague at 10 a.m.
The commitment of both foundations is clear. They want the Ministry of LNV to make its justification for the feed measure transparent and public. If the court decides that this is indeed necessary, the disclosure of the substantiation will probably take place exactly one month before the start of the measure.
Interim injunction
The STAF and Nitrogen Claim initiated summary proceedings after the ministry ignored the ultimatum issued by the foundations. The parties gave LNV the time on Thursday 16 July to make the substantiation of the feed measure public before 12 noon the following day (Friday 17 July). This ultimatum was subsequently ignored, after which STAF and Nitrogenclaim initiated summary proceedings.
Last Tuesday it was indicated that the ministry would come out with the requested substantiation, but not within the set time limit. If a different decision is made in court next week, the ministry seems to have little choice.
