The Nitrogen Claim Foundation accuses the Province of Gelderland of having signed nitrogen-sensitive nature without informing stakeholders (such as farmers). That is why the interest club is now starting legal proceedings.
According to John Spithoven, chairman of the Nitrogen Claim Foundation, this concerns 63.000 hectares of cultivated land, including around the floodplains of the Rhine and the Veluwe, which are quite far outside Natura2000 areas. There are many farmers in these areas who are being duped by this action according to Nitrogen Claim, because they are now suddenly seen as so-called peak loaders.
According to Spithoven, nitrogen-sensitive nature has been quietly added not only in Gelderland, but also in other provinces. This may have consequences for the development opportunities for the agricultural companies concerned. There is also the possibility of depreciation of the land. And because, in their own words, the signing process went without a hitch, according to Nitrogenclaim, stakeholders were also unable to monitor the course of events.
Procedure
Nitrogen claim believes that the province should have informed the interested parties in advance about their plans and has therefore started legal proceedings. Nitrogen claim summons the Province of Gelderland to recognize liability within 5 days and to enter into discussions with the interested parties. If not, the case will be referred to the court.
