Greek remains liable for Lyempf bankruptcy

The Greek shipowner John K. remains liable for the bankruptcy of dairy company Lyempf in 2011. He has always presented a different picture of the course of events surrounding the bankruptcy of the company than what actually happened and, among other things, violated the accounting obligation.

The Arnhem-Leeuwarden Court of Appeal has determined this in higher appeal. The shipowner has been trying to avoid responsibility for the bankruptcy for years. He was convicted of forgery in 2019 and sentenced to prison, but avoided a conviction for bankruptcy fraud.

Suppliers are still owed millions
K. promised in 2010 to invest €12 million in the dairy factory, but withdrew €6 million from Lyempf's account. Bankruptcy followed. This also meant a noose for a large number of Lyempf's suppliers. The NoorderlandMelk cooperative and Flevo Melk, among others, were still owed millions by the company. To date, little of this money has been returned. The factory was later bought and modernized by Ausnutria.
