Both the provinces of Overijssel and Noord-Brabant are trying to prevent damage to farmers through actions by the Forum. In Overijssel, the number of enforcement cases for PAS reporters is limited as much as possible, Brabant is suspending the granting of permits for low-emission stables.
This is evident from announcements from both provinces. In Overijssel, enforcement was requested from 'a first batch' of 50 agricultural companies, a spokesperson reported.
When checking these requests, it turned out that not all 50 companies had committed a violation, according to the province. A total of 27 of the 50 companies could be removed from the list upon closer examination. Enforcement efforts have been made at the remaining 23 companies, but it has not yet been established whether a violation has actually occurred. If this is the case, it will be examined how enforcement can still be prevented. According to the province, there has not yet been any acute enforcement, but in some cases enforcement seems unavoidable.
No permit for required stable
The same problem is currently not present in North Brabant, but permits for low-emission stables are in danger of being rejected. Earlier this year, more companies lost the permit for a stable that had been approved as low-emission. The MOB cooperative threatens to have more of these types of stables rejected because the claims cannot be substantiated in practice. To prevent this, the province is temporarily suspending the approval of new applications for these types of stables. This does pose a new problem, because livestock farmers who want to continue doing business in North Brabant are only allowed to do so if they have a low-emission stable.
The date remains, but with leniency
According to the province, the date of 1-1-2024 remains for compliance with the provincial emission requirements. This will not be changed, but it is still hoped that approval for the low-emission stables will still be obtained. In addition, the provincial permit desk remains open. Dairy farmers can submit a pro forma permit application there. This means that the province can start working on it immediately as soon as there is clarity from the ministry. Farmers also receive the certainty that they have applied for their permit on time, but are not yet confronted with high costs. "If we cannot grant the requested permit on time, for whatever reason, we know that the livestock farmer has started on time and we will also take this into account on 01/01/24, as indicated in the roadmap for stable adjustments 2024, the province said.
Multiple legal teams
This problem has now caused a lot of unrest among livestock farmers. LTO-Netherlands is trying to do something about the permit problem through consultation with the government. Alternative farmer organizations, such as the Stikstofclaim Foundation, the Farmers Defense Force and Agractie, each deploy their own legal teams, all to prevent enforcement. The central government has not yet provided a solution to the problem of PAS detectors and those affected by low-emission (but not working) stable systems.
