The approval of a new derogation cannot be issued by Brussels before 1 January 2018. This is announced by the Ministry of Economic Affairs. The ministry is not yet able to say what this means for the introduction of phosphate rights as of 2018.
A final decision will not be made until the beginning of 2018 whether the Netherlands can make use of the derogation again. The Ministry of Economic Affairs (EZ) has announced this.
Security is missing
The Ministry of Economic Affairs nevertheless indicates that it is 'on schedule'. The ministry expects to be able to start discussions about derogation in Brussels this autumn. The European Commission has also indicated that it is prepared to discuss the derogation. However, only if they have more certainty from the Netherlands about the progress of the phosphorus reduction plan.
Implementation of the sixth action programme
In addition, Brussels is still awaiting the final package of measures relating to the sixth action programme. This is because the Netherlands has not yet completed this interpretation. Only when the proposed package of measures has been assessed with a pass (it must be able to form a basis for a new derogation) can consultations about the precise interpretation of a new derogation start.
Concrete package
The ministry is working with the sector, stakeholders in the field of water quality and other governments on a concrete package of measures. The Ministry of Economic Affairs wants to reach an agreement this summer about the details of the package of measures, so that the formal procedure can also be started in the Nitrate Committee after the summer.
On 29 June, the House of Representatives will debate the details of the sixth action program for the first time.
Phosphate rights?
The Ministry of Economic Affairs was not yet able to indicate in concrete terms what this means for the introduction of the system of phosphate rights in 2018. The condition for the introduction of this system is a new derogation in 2018.
Last week left Kees Roman, chairman LTO Dairy Farming, already know that he did not expect that the Dutch government would succeed in obtaining approval for the sixth Nitrates Directive action program before 2018 and thus the derogation.
