Delay in summary proceedings Schouten feeding measure

21 July 2020 - Erik Colenbrander - 1 reaction

The summary proceedings that Agri Facts and Nitrogen Claim filed last Friday against the concentrates regulation of agriculture minister Carola Schouten has been delayed. The foundations want to uncover the substantiation of the ministerial feed measure.

The state attorney has let it be known that the ministry will provide the requested substantiation, but not within the time limit set by the foundations. John Spithoven, chairman of the Nitrogen Claim Foundation, says that as far as he is concerned, the summary proceedings will take place as soon as possible. The lawyer who represents the case for the foundations also has contact with the state lawyer.

Ministerial consultation
Spithoven has appealed to all agricultural dairy parties involved to cease consultations with the Ministry of Agriculture about the announced feed measure and the feed policy for 2021, until the substantiation of the feed measure has been established through the legal process. "We are not a representative. But last week we did agree with the various parties from the agricultural advocacy that we have been negotiated," he says.

Nevertheless, these parties, of which Spithoven does not want to indicate which exactly, were joined on Tuesday morning at a consultation at the ministry. The chairman of Nitrogen Claim says that he is unhappy with these consultations. "Now the case is with the judge. Then it is not wise to start negotiating again against the agreements."

What came before
STAF and Nitrogen Claim demand full access to the substantiation of the feed measure. Last Thursday, July 18, the Ministry of Agriculture received until 19:12.00 noon on Friday XNUMX July to provide the missing information. When that did not happen, the procedure for interim injunction started.

According to STAF, the ministry itself 'derived' the protein limits for the 9 soil type-intensity combinations on the basis of samples from dairy farms in the BIN monitoring network. But the calculations are not always consistent with practical figures, STAF believes. These practical figures are figures from the animal feed world and the Kringloopwijzer, which are not public. The foundations also do not agree with the way in which the minister dealt with advice from the Committee for Experts on Fertilizers (CDM).

LTO naturally again (against agreements made by sector parties) at the consultation table as a reliable discussion partner for the minister.
Who still pays these kind of fumblers who knowingly ruin things for the entire sector?!
