Judge finally puts a line through POR scheme

The Trade and Industry Appeals Tribunal (CBb) has put an end to the POR regulation (the Production Rights Exemption Regulation). The administrative authority announced this on Tuesday 9 April.

Several pig and poultry farmers had submitted a request for an exemption from the expansion ban, but the CBb has now rejected this. This means that Minister Carola Schouten (Agriculture, Nature and Food Quality) is within her right to POR Control to be rejected as of 1 January 2018.

Controlling manure production
Controlling manure production, which is necessary to maintain a derogation for broader manure standards, weighs more heavily in court than the economic benefits that the POR scheme has for pig and poultry farmers. The motivation is also that entrepreneurs knew that there was an end date to the exemption, so that the duration was clear from the start.

In addition, the choice to participate in the scheme was a voluntary entrepreneur's choice. Earlier, the CBb announced that it would not institute a preliminary injunction until the court's final decision.
