BB TV: Marieke Toonders

Grower disproportionately burdened in phosphate plan

10 August 2017 - Redactie Boerenbusiness - 12 comments

The judge has again decided that 200 dairy farmers do not have to cull cows for the time being. Marieke Toonders, lawyer at Linssen Advocaten, represents 140 of the 200 farmers who went to court over the phosphate reduction plan.

She explains the verdict, gives advice on the light test of the Netherlands Enterprise Agency (RVO.nl) and looks ahead to the appeal in September.

Grower could have known that "something" was coming to curb growth beyond quota. If the non-grower now has to hand in extra as a result of the grower, it is also disproportionate!! Hopefully Van Dam will win the summary proceedings on September 18 and we will all be cut proportionally.

Irreversible financial obligation is the entrepreneur's risk!!
Or does this only apply to the so-called big mega boys!!!

Every dairy farmer has an irreversible financial obligation, even if it was concluded (for example 10 years earlier) with his own company.

Totally agree Peter,
There are a lot of crazy things going on in the industry right now. With Campina leading the way to save the large intensive farmers (board members) from high manure disposal costs...
A disgrace, and administrative criminal!

we still have the same number of dairy cattle as before the introduction of the milk quota the barn dates from 1972, with just under 60 berths for dairy cattle, there are probably more colleagues who have also grown little or not, but still have an income with this number until their retirement.
we now have to give up 8.3% or even more for the growers, making our income even lower, compared to even more rules and charges.
Should we now also hire linsen lawyers?

How was the discount on pig phosphate rights 21 years ago, 15% with the prospect of another 10%, not a single person except the pig farmers who shed a tear LTO WAS FOR, don't be pathetic now, don't whine people

Why do the non-growers have to bloom for those big-necks.
I think that everyone should give in the same amount and then everyone can fill it in in their own way. This is for everyone to wear otherwise you have done something wrong. Most fast growers acted knowingly. You shouldn't put this on someone else's plate.

totally agree yo. we didn't cause it, but we do take the heaviest blows.

You can always submit your own to everything with all those laws and regulations, but once is enough. Nor do they want to take away spaces from non-growers, but simply to overthrow these plans. There's still plenty of room. It's just paperwork. Ceiling just needs to be stretched to start with export and add bex benefits

what a nonsense, you run a risk when you invest.
it is now at the expense of the farmer who has not produced a surplus.

Who wants to respond to the following statement.

A small number of livestock farmers undermine the phosphate reduction plan.

Can the non-entitled livestock farmers recover any damage they may have from the entitled livestock farmers?
(Most dairies have voted democratically about the introduction of a phosphate reduction plan)

Who knows may say.

there was also a shortage regulation for pig rights at the time.
This was also necessary otherwise too many would fall over.
It's a shame they didn't come up with a better plan. I still don't understand how many foremen have gone along with this. Without a good foundation, everything comes crashing down.
From my part, derogation will be removed, at least for everyone on a level playing field.
