Are phosphate rights a business asset or not? For whom is this question important and what are the consequences? These issues are discussed with Alies Visscher, tax advisor at Countus.

With a good comparison between milk quota and Phosphate rights, you will have to calculate with phosphate rights for young stock.
So say 50 kg of phosphate per dairy cow at 200 euros is 10.000 euros per cow versus milk quota 20.000 euros per cow, so there is still some light between these amounts.

If it is a business asset, the stopping farmer will have to pay the tax with 52% and the acquirer will be able to depreciate it.
